bribery scandal

But, as determined by the investigation carried out by prosecutors Schiappa Pietra and Edery, the bribery payments did not end in Traferri, but involved two representatives of the Public Ministry, the aforementioned Ponce Asahad and Serjal.
Ponce Asahad was sentenced to six years in prison for bribery. The sentence was reduced to three years in prison, because he declared as a defendant a collaborator and involved his superior Serjal de el, who has a pending request for elevation to trial.
With the same evidence, prosecutors Edery and Schiappa Pietra founded the indictment against Traferri. But in the case of the senator, the process did not advance.
The fueros, a shield
In principle, Traferri was summoned to the imputation hearing for December 11, 2020. But the senator maintained that he could not be accused because he enjoyed parliamentary privileges, an argument that he maintained throughout the process and, at present. Traferri always denied the charges against him and accused prosecutors.
Faced with the legislator's refusal, the prosecutors requested the removal of jurisdiction. But in a session held on December 18, the Santa Fe Senate rejected the request by twelve votes against, three abstentions and four votes in favor. Thus, the political leader of San Lorenzo maintained his immunity.
So, with the legislative path closed by Traferri's colleagues, the prosecutors took the judicial route to ensure that the senator can be imputed and submitted to the process. To this end, they filed a request to declare the unconstitutionality of articles 51 and 27 of the provincial Constitution and the Code of Criminal Procedure, respectively.
But, last February 22, the Supreme Court of Justice of Santa Fe rejected the request of the representatives of the Public Ministry to declare the unconstitutionality of the norms that enable the immunity of legislators.
Five of the members of the highest court in Santa Fe voted against the prosecutors' request. The only dissenting vote corresponded to Judge Daniel Erbetta.
In addition to the resolution that the Inter-American Commission on Human Rights may dictate, the prosecutors have another possibility to declare the unconstitutionality of the laws that grant parliamentary immunity to Traferri: the presentation of an appeal before the Supreme Court of Justice of the Nation.
